🇿🇦 South Africa: crypto-asset services

FSCA oversight, financial services and licensing.

Educational status • 21 October 2026: Regulatory requirements are jurisdiction- and activity-specific. Verify current primary documents before relying on any statement.

Documented regulatory approach

South Africa’s Financial Sector Conduct Authority (FSCA) declared crypto assets a financial product under the Financial Advisory and Intermediary Services (FAIS) framework in 2022. The declaration brings relevant advice and intermediary services within FSCA oversight.

Licensing

The FSCA states that crypto-asset service providers conducting regulated financial services must obtain the relevant authorisation. The precise duties depend on the business model; the declaration does not make every token legal tender.

Before using a provider

Check the provider’s authorisation directly with the FSCA, read disclosures and assess custody, complaints procedures and fraud risks.

Practical scenario

A company giving crypto-asset investment advice to South African clients should verify its FAIS obligations before launching, rather than relying on a general business registration.

Official sources and verification

Consult the regulator's latest publications, legal texts and licensing records. Links below are starting points, not evidence that any particular provider is authorised.
