HILEX DIGITAL
AFRICAN DIGITAL ASSET REGULATION • STAGE 3

African Regulation • Lesson 6 of 6

🏢 Business compliance in Africa

Practical due diligence for digital merchants and platform developers.

Educational status • 21 October 2026: Regulatory requirements are jurisdiction- and activity-specific. Verify current primary documents before relying on any statement.

Identify the activity

Distinguish education and software development from custody, brokerage, exchange, payments, investment advice and remittances. A technical platform can trigger financial regulation depending on what it actually does.

Build safeguards

Map KYC/KYB and AML/CFT duties where applicable; protect customer information; maintain transaction records; publish accurate pricing, risk warnings and complaint channels.

Cross-border operations

Review licensing, foreign-exchange, tax, sanctions, privacy and consumer obligations for each country served. Hosting a website abroad does not necessarily remove local requirements.

Practical scenario

A merchant directory or e-commerce platform may need privacy and consumer safeguards even if it never handles crypto. Adding custody or payments features can create further obligations.

Technology provider boundary

A software development provider can build tools and documentation, but cannot promise that a client’s business will be legally compliant.

Official sources and verification

Consult the regulator's latest publications, legal texts and licensing records. Links below are starting points, not evidence that any particular provider is authorised.
