Understanding the GENIUS Act
Legal status: Enacted U.S. law; OCC final implementing rule issued 21 October 2026; OCC rule effective 18 January 2027.
Reviewed: 21 October 2026 • Language: English (additional translations planned)
What does it regulate?
The GENIUS Act creates a U.S. federal framework for payment stablecoin issuance. A payment stablecoin seeks to maintain a stable value relative to a monetary amount, typically the U.S. dollar. It is different from a freely fluctuating cryptocurrency.
What changed in October 2026?
The Office of the Comptroller of the Currency (OCC) published its final implementing rule for issuers under OCC jurisdiction. The rule addresses reserves, redemption, supervision, risk management and related activities. Other agencies and requirements may follow separate processes.
What should a learner understand?
Reserve backing and redemption arrangements matter. Regulatory permission is specific to the issuer and activity; it is not a blanket government guarantee that every stablecoin is risk-free.
Implications for African businesses
Stablecoin payments may offer cross-border settlement options, but businesses must assess local currency, exchange-control, consumer-protection, tax and AML requirements. U.S. regulation does not itself authorize stablecoin activities in African countries.
